Carrying or transporting a handgun in Ohio requires a clear understanding of the state’s gun laws. It can be confusing to know exactly what is allowed and what might lead to legal trouble. Even a small mistake can have serious consequences. Being informed about these requirements is essential to making sure you don’t inadvertently do something that could get you into serious trouble, making you a defendant in a criminal case

Certain People Prohibited From Owning or Possessing a Firearm

One of the first laws to be aware of is that some people are prohibited from owning or possessing a firearm, meaning they can’t carry, wear, or transport one either.

For example, the following groups of people are generally prohibited:

  • Those suffering from chronic alcoholism or dependency on controlled substances
  • Individuals who have been declared mentally incompetent, mentally defective, or mentally ill by a court, or who have been ordered to live in a mental institution
  • Anyone who is a fugitive from justice, or who has been charged or convicted of violent felonies or drug offenses involving illegal possession, sale, distribution, or trafficking of controlled substances

If none of these conditions apply, you are generally allowed to own and possess a firearm in Ohio.

Carrying/Wearing a Concealed Firearm in Ohio

In Ohio, you can carry a concealed handgun without a permit if you are over 21. This permitless carry law took effect in June 2022. However, there are important restrictions to keep in mind. For instance, some locations are completely off-limits for carrying a concealed firearm.

These generally include:

  • Police stations and sheriff’s offices
  • Correctional facilities and airport terminals
  • Courthouses and mental health facilities
  • Universities, unless explicitly allowed
  • School safety zones

Additionally, if you are carrying a concealed handgun, you must have another valid form of government-issued identification with you at all times.

Transporting a Firearm in Your Vehicle in Ohio

When transporting a firearm in your vehicle in Ohio, it’s important to know that different rules apply depending on whether you have a concealed carry permit (which people sometimes get even though it is no longer required).

With a Concealed Carry Permit

If you hold a permit, you are allowed to keep a loaded, concealed handgun in your car.

Being under the influence of drugs or alcohol while transporting a concealed weapon is taken very seriously. This behavior is considered a 5th-degree felony and can lead to up to a year in jail and a $2,500 fine.

Without a Concealed Carry Permit

If you do not have a permit, you must ensure your firearm is unloaded before transporting it. The firearm should be kept in a closed package, box, or case, or placed in a compartment that you can only get to by exiting the vehicle. Alternatively, it can be stored in plain sight if it is secured in a rack or holder designed for that purpose.

Failing to follow these rules is treated as a 4th-degree felony, with penalties including up to 30 days in jail and a $250 fine.

What to Do if You’re Facing Firearm Charges in Ohio

If you’re facing firearm charges in Ohio, there are steps you can take to ensure your rights are protected.

Consider the following actions:

  • Get in touch with an attorney who has experience with firearm laws in Ohio.
  • Collect any documents, receipts, or other evidence related to your case.
  • Refrain from discussing details of your case with anyone except your lawyer.
  • Follow your attorney’s guidance closely and ask questions if anything is unclear.

Taking these measures can help you navigate the legal process with a better understanding of your situation.
